The trial of a man accused of driving dangerously on the Bingara Rd in September 2023, resulting in the death of a 27-year-old man, has begun at Armidale Local Court.
Harvey Matthew Ovenden has pleaded not guilty to dangerous driving causing the death of Luke John Wells in an incident where Ovenden, driving a red Mazda BT-50 on Bingara Road, was involved in a head-on collision with a white Toyota Hilux.
In an item in the Northern Daily Leader, Crown Prosecutor David Morters told the court Mr Ovenden failed to keep his vehicle on the correct side of the road, leading to the fatal crash, resulting in Mr Wells suffering serious injuries which led to his death.
Ovenden’s senior barrister David Dalton said Ovenden had purposely taken evasive action to his right – onto the incorrect side – to avoid Mr Wells’ Hilux who they will argue was driving on the wrong side of the road.
Photos and further evidence was set to be given yesterday with the trial likely to last a week.
