Man Convicted After Accident in 2023

A man has been found guilty for causing the death of a man following a head on collision on the Bingara Rd in 2023.

The Northern Daily Leader reports that the jury found Harvey Matthew Ovenden had driven in a dangerous manner in the moments leading up to a crash that claimed the life of Luke John Wells.

Ovenden’s senior barrister, David Dalton said two crash experts and a crash reconstruction expert could not exclude Ovenden’s account that he had swerved his Mazda BT-50 to the incorrect side of the road to avoid Mr Wells’ white Toyota Hilux, which he said was driving north in the wrong lane.

Crown Prosecutor David Morters had earlier dismissed Mr Ovenden’s account of events, pointing to the testimony of Jaclyn and Cameron Lindsay, who, he said, remained emphatic about the assertion Ovenden had been on the wrong side of the road at the time of the crash.

A formal sentencing will be handed down by Judge James Bennett in Sydney in January.
